Empty legs vs conventional charter: when is the discount worth considering?
Treat an empty leg as a conditional travel opportunity unless the controlling agreement establishes otherwise. Victor’s published terms explicitly make its empty-leg performance dependent on the primary charter operating; cancellation of that primary flight triggers cancellation and a refund under the stated provision. That is a specific contractual example, not a claim that every seller uses identical terms. (flyvictor.com)
| Question | Empty-leg proposal | Conventional charter proposal |
|---|---|---|
| What supports the flight? | Establish dependence on another itinerary | Establish the commitment to the buyer’s itinerary |
| What can change? | Request permitted timing, airport and aircraft changes | Request change and substitution provisions |
| What happens after cancellation? | Distinguish refund from replacement transport | Distinguish sourcing assistance from a funded replacement |
| What should finance budget? | Flight price plus a separately identified fallback | Quoted mission cost plus unresolved contingencies |
| When should it be shortlisted? | Our recommendation: flexible travel with an acceptable fallback | Our recommendation: deadline-led missions, subject to adequate recovery terms |
What does a useful recovery clause need to answer?
Do not accept “we will look after you” as the complete answer. Request written responses to:
- Which events trigger assistance: aircraft unserviceability, crew unavailability, weather or other disruption?
- Is the obligation to search, offer, provide, or pay for replacement transport?
- Is there a response deadline or an arrival-related commitment?
- What aircraft or airport substitutions may be proposed?
- Who pays the price difference, repositioning, additional transfers and accommodation?
- What exclusions, caps and refund provisions apply?
- Who can approve emergency expenditure outside office hours?
For fixed-deadline travel, test recovery backwards from the event. An alternative aircraft that cannot arrive before the required reporting time does not solve that mission. Record the latest useful fallback departure and the person authorised to activate it.
