14. What must an air charter broker disclose under Part 295?
For transactions covered by Part 295, some disclosures are mandatory and others must be supplied when requested. Section 295.24 distinguishes the two groups. (ecfr.gov)
| Disclosure category | Information |
|---|---|
| Required before contracting, subject to provisions for unknown or changed information | Direct carrier identity; the broker’s contractual capacity; existence or absence of broker liability insurance and its limits |
| Required on request before contracting | Relevant broker–carrier business relationships when the broker acts as the charterer’s agent; total cost through the broker; known third-party charges or good-faith estimates |
The rule requires timely provision of information that was unknown or subsequently changes, and all required or requested information must be disclosed before transportation begins. Failure to provide information within the prescribed reasonable-time framework can trigger cancellation and refund opportunities. Individual charges do not have to be itemised merely because the total-cost disclosure is requested. (ecfr.gov)
Practical action: request all six categories in writing. Preserve the reply with the agreement, and have aviation counsel assess any material disclosure dispute.
